Terms of Service

These Terms of Service ("Terms") govern access to intakepos.com and the Intake application (the "Service"). By using the Service, you agree to these Terms.

The Service

Intake provides buy-side purchasing tools for merchants on Shopify. The Service may change over time as we add or adjust features. We may suspend or discontinue parts of the Service with reasonable notice when practical.

Accounts

You must have authority to bind the merchant business that installs Intake. You are responsible for staff access, PIN and credential security, and activity under your store's account. Keep Shopify and Intake access limited to authorized people.

Acceptable use

• Use the Service only for lawful business purposes
• Do not attempt to break, probe, or overload the Service
• Do not misuse customer or seller data collected through Intake
• Comply with Shopify's terms, applicable pawn/secondhand laws, and any reporting rules that apply to your shop

Merchant data and compliance

You own the transaction and customer data you enter. You are responsible for obtaining any consents required to collect identity documents, photos, and related records, and for how you use compliance integrations. Intake is a tool; it does not replace legal advice.

Billing

Fees, if any, are charged through Shopify's billing for the app unless we agree otherwise in writing. Taxes may apply. Failure to pay may result in suspension of the Service.

Intellectual property

Intake and its branding, software, and site content remain our property (or our licensors'). These Terms do not grant you rights to our trademarks beyond using the Service as intended.

Disclaimer

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, Intake and its suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Service. Our aggregate liability for claims relating to the Service is limited to the amounts you paid us for the Service in the twelve months before the claim.

Termination

You may stop using Intake and uninstall the app at any time. We may suspend or terminate access if you violate these Terms or if required to protect the Service or other users. Provisions that by nature should survive (including ownership, disclaimers, and liability limits) will survive termination.

Changes

We may update these Terms. The "Last updated" date will change when we do. Continued use after changes constitutes acceptance. If you do not agree, stop using the Service.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, unless a mandatory local law applies to your business.
